About 'settling debt'|The Iraqi Central Bank: file of Iraq's debts will be settled completely as soon as possible
Imagine settling a debt with an original creditor only to have it come back two years later as a debt that is $2,000 more than you ever owed. This sounds like something that should never happen, right? Unfortunately, it does happen. Unscrupulous debt collection agencies will buy debts that you don't even owe and try to collect on them. Two years ago, I had a lemon of a car. I had to keep taking it in for service as it was constantly overheating and having other engine problems. I was still paying for this car, but had it very nearly paid off. I missed one payment because I had been unable to get to work in order to make the payments and the car was repossessed. Normally, a car would be sold at auction and I would have to pay the remaining balance, but instead the company sent me a certified letter stating that with me returning the car, they were considering my account paid in full, and the debt forgiven. I thought that was the end of it. Fast forward 2 years. I'm on vacation with my new husband and baby, for my birthday when I get a phone call on my cell-phone from someone stating that I owe $8500 to this loan company. The amount that I had owed on the car when it was repossessed was $6500. I state that I have a letter from the original creditor and will be happy to fax it to them as soon as I could get back to my files. They continued calling me throughout my vacation, making it a rather unpleasant experience. Upon returning home, I find the letter and call them back stating that I will be more than happy to fax them the letter. I get a man on the phone claiming to be a lawyer. This man breaks many FDCPA rules in a single phone call. He is first and foremost extremely rude, stating that the letter I received means absolutely nothing. He spoke to me as if I were an ignorant child and told me that because I signed the original contract, I still owed the money, even if the original creditor had put it in writing that I no longer owed this debt. He then proceeded to threaten me claiming that I was being served with a court summons and that if I did not show up to court, I would be arrested. All this he put under the guise of "just trying to help you, ma'am." After this display, he then proceeded to tell me that I was the one being rude when I became exasperated by his tactics. Needless to say, I never received the notice that I was being sued, as it is illegal for him to do so. I never got arrested, and I have been working directly with the credit bureaus to have that mark removed. I looked up the phone number that they were calling from and discovered it belonged to Sentry Recovery Systems. This is just one experience with one debt collection agency. This is not the only agency to break the law, thinking that the person on the other end of the line is ignorant. There are some that will advertise your debt to your children or friends, also very illegal. There are those who will keep calling in spite of the fact that it is not your debt. If you have a phone number that ever belonged to another person in debt, you will continue to get calls for that person no matter how many times you inform them that they have the wrong number. I have yet to meet a debt collection agency representative who is courteous. I have found many that I have worked with to be condescending and cruel individuals. They don't really care if you actually owe the debt, they will try to collect anyway, just to get their money. This causes me to believe that the world would be a better place if these agencies were outlawed. At the very least, any agency caught breaking the law should be shut down immediately and their business licenses revoked. Maybe the threat of losing their business altogether would cause them to re-evaluate their business practices. |
